Welcome to the AllSome Track website (the "Site"). These terms and conditions ("Terms and Conditions") apply to the Site, Yimport Enterprise (002297420-X), and all of its divisions, subsidiaries, and affiliate operated Internet sites which reference these Terms and Conditions. “Yimport” means Yimport Enterprise, an enterprise incorporated in Malaysia under registration number 002297420-X. By accessing the Site, you confirm your understanding of the Terms and Conditions. If you do not agree to these Terms and Conditions of use, you shall not use this website. The Site reserves the right, to change, modify, add, or remove portions of these Terms and Conditions of use at any time. Changes will be effective when posted on the Site with no other notice provided. Please check these Terms and Conditions of use regularly for updates. Your continued use of the Site following the posting of changes to these Terms and Conditions of use constitutes your acceptance of those changes.

USE OF THE SITE

We grant you a non-transferable and revocable license to use the Site, under the Terms and Conditions described, for the purpose of parcel tracking and AllSome Track NearPost services on the Site. Commercial use or use on behalf of any third party is prohibited, except as explicitly permitted by us in advance. Any breach of these Terms and Conditions shall result in the immediate revocation of the license granted in this paragraph without notice to you.
Certain services and related features that may be made available on the Site may require registration or subscription. Should you choose to register or subscribe for any such services or related features, you agree to provide accurate and current information about yourself, and to promptly update such information if there are any changes. Every user of the Site is solely responsible for keeping passwords and other account identifiers safe and secure. The account owner is entirely responsible for all activities that occur under such password or account. Furthermore, you must notify us of any unauthorized use of your password or account. The Site shall not be responsible or liable, directly or indirectly, in any way for any loss or damage of any kind incurred as a result of, or in connection with, your failure to comply with this section.

USER SUBMISSIONS

Anything that you submit to the Site and/or provide to us, including but not limited to, questions, reviews, comments, and suggestions (collectively, "Submissions") will become our sole and exclusive property and shall not be returned to you. In addition to the rights applicable to any Submission, when you post comments or reviews to the Site, you also grant us the right to use the name that you submit, in connection with such review, comment, or other content. You shall not use a false e-mail address, pretend to be someone other than yourself or otherwise mislead us or third parties as to the origin of any Submissions. We may, but shall not be obligated to, remove or edit any Submissions.

ORDER ACCEPTANCE AND PRICING

Please note that there are cases when an order of service cannot be processed for various reasons. The Site reserves the right to refuse or cancel any order for any reason at any given time. You may be asked to provide additional verifications or information, including but not limited to phone number and address, before we accept the order for your placed services.
We are determined to provide the most accurate pricing information on the Site to our users; however, errors may still occur, such as cases when the price of an item is not displayed correctly on the website. As such, we reserve the right to refuse or cancel any order. In the event that an item is mispriced, we may, at our own discretion, either contact you for instructions or cancel your order and notify you of such cancellation. We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card or bank account charged.

TRADEMARKS AND COPYRIGHTS

All intellectual property rights, whether registered or unregistered, in the Site, information content on the Site and all the website design, including, but not limited to, text, graphics, software, photos, video, music, sound, and their selection and arrangement, and all software compilations, underlying source code and software shall remain our property. The entire contents of the Site also are protected by copyright as a collective work under Malaysia copyright laws and international conventions. All rights are reserved.

TERM OF USE OF NEARPOST SERVICES

These following stated End User Terms of Services sets out the terms of use on which you may make use of the AllSome Track NearPost Services (as defined below). Please read these End User Terms of Service carefully before you start to use the AllSome Track NearPost Services. By registering to access AllSome Track NearPost services, you indicate that you have read, understood and accept these End User Terms of Service, together with our privacy policy and you are agreed to abide by them. You are encouraged to read these End User Terms of Service, and contact us if you have any particular questions in relation to the AllSome Track NearPost Services. In these End User Terms of Service "you" includes anyone acting on your behalf or with your express or implied authority.

1. Our Contract with You
1. These are the terms & condition, together with the Privacy Policy, are the basis on which we offer the Service to you following your registration on the AllSome Track Website. By registering on the AllSome Track Website, you agree to be bound by these stated terms & conditions.
2. Registration Process
1. You must register on the AllSome Track Website, prior to requesting and/or booking NearPost services.
2. In order to complete the online registration process, you must supply the Site with your personal details, including your mobile number and email. This information will be held by the Site in accordance with the stated Privacy Policy.
3. Once your registration is successful, you will receive a verification email. You must verified your account by clicking on the given link which will be included in your verification email.
4. After logging into your account using your mobile number, you can enjoy all the providing NearPost services, including NearPost collection.
5. The Site reserve the right to verify and request for further verification documents to avoid fraud and identity theft through email and/or phone call. The Site reserve the right to freeze and suspend user account if report was found for further investigation.
3. Pricing
1. You will be charged RM1.00 per parcel collection. By using NearPost service, you are agreed to pay the stated service fee to the manager of NearPost Station upon collection.
2. AllSome Track reserve the right in our absolute discretion to adjust the NearPost Station service price and/or the subscription price upon advanced notice to our users via email.
4. Request for NearPost Services
1. When making a booking, you undertake:
• To ensure the delivery of any goods do not, by all means, contain or comprise of Prohibited Articles;
• To book a NearPost Collection service prior to the parcel delivery. Once the booking was placed, please enter the address of the selected NearPost Station as your recipient’s address for your parcel. You are encouraged to include your mobile contact for reference while filling up the parcel recipient's address.
• To enter the tracking number and Courier Company of your parcel onto AllSome Track NearPost order for tracking usage.
2. Once your parcel is received by NearPost Station, you will receive a notification email with a collection PIN code.
3. Upon receiving the notification email, you must collect your parcel from the selected NearPost station within 14 days. If the parcel was not collected within 7 days after the notification email, you will be charged for storage fee of RM1.00 per day and up to 14 days.
5. Parcel Collection
1. When collecting your parcel you must provide the NearPost Station with:
• The unique 6 digit PIN code which you can retrieve from your notification email and NearPost order after logging into AllSome Track system.
• Proof of identity is requested and kept for record upon request, including valid passport, identity card (I/C), driving license or student card.
• Without a valid PIN code and verification upon request, NearPost Station reserves the right not to pass you the parcel due to security consideration.
2. If you are assigning another person to collect your parcel on your behalf, they will need to provide the 6 digits PIN code that you have received through the notification email. You are not encouraged to disclose the collection PIN publicly. Similarly, proof of identity is needed upon request.
   Without a valid PIN code and verification upon request, NearPost Station reserves the right not to pass you the parcel due to security consideration.
3. You can check your parcel status by logging into AllSome Track under NearPost order. The feature also allows you to track your parcel where-about, even before it was received by NearPost Station.
4. If you fail to collect the Parcel within the stated period or duration, AllSome Track reserve the right in our absolute discretion at any time after 14 days following delivery to return the Parcel to the sender at your cost, including the extended storage fee of RM1.00 per day after 7 days, the courier cost and 20% of administration fee.
5. You will be receiving a notification email regarding the return and the progress is traceable through AllSome Track system.
6. Supply of NearPost Service
1. We shall supply the NearPost Service to you using reasonable care and skill.
2. We have absolute discretion as to the means and procedure to be followed in the handling and storage of Parcels delivered to NearPost Station.
3. NearPost Station reserve the right to reject delivery of a Parcel from Courier Company if:
• You are not AllSome Track registered user;
• You did not book a collection service prior to parcel delivery;
• You did not enter the tracking information to AllSome Track NearPost order and/or did not your identifiable mobile number on the Parcel;
• The Package:
• Exceeds the weight of 20 kilograms and/or exceed the dimension of 50 centimetre x 50 centimetre x 50 centimetre;
• Appears to be damaged or broken upon receive;
• Appears to contain Prohibited Articles as stated in 7.
4. If the Parcel was rejected due to the above reason, you will receive a notification email by stating the rejection reason(s).
7. Prohibited Articles
1. Prohibited Articles include but are not limited to:
• Any objects or substance that are either illegal in the jurisdiction or in respect of which carriage or possession is illegal in the Jurisdiction.
• Gases, pyrotechnics, arms and ammunition or corrosive, toxic, flammable, explosive, oxidizing or radioactive materials or any other noxious, dangerous or hazardous goods or goods likely to cause damage.
• Money, prescribed drugs, liquids, foodstuff, perishable goods, coins, or plants or plant seeds or derivatives.
• Any item of high value including without limitation jewellery, bullion, deeds, bonds, securities, stamps, antiques, fine art.
• Animals or any creatures.
• Any item that requires specialist storage or storage at a specific temperature.
2. If you nevertheless (whether knowingly or unknowingly) place a booking request which results in a Prohibited Article being delivered to a NearPost Station, we shall be under no liability whatsoever in connection with the Prohibited Article however arising and you shall be liable for any and all loss or damage caused by, or in connection with the Prohibited Article however arising and shall indemnify us against all penalties, claims, damages, costs and expenses whatsoever arising in connection therewith and the Prohibited Article may be destroyed or otherwise dealt with in our absolute discretion by us or by any other person in whose custody they may be at the relevant time.
3. We shall be entitled, in our absolute discretion to suspend or cancel your registration if you arrange for Prohibited Article to be delivered to one of our NearPost Station.
8. Our Liability
1. All Parcels delivered to NearPost Station are held there at the Customer's risk. We do not accept liability for any loss or damage caused to Parcels whilst they are being held at NearPost Station.
2. Notwithstanding Clause 8.1 above, in the event that you have entered the tracking number and used courier company onto AllSome Track with (i) valid proof of delivery to the NearPost Station; and (ii) confirmation of the value of the Articles contained in the Parcel, we may in our absolute discretion elect to compensate you up to a maximum of RM200.00 per Parcel. In order to be eligible to receive such compensation, you must provide us with the above information in writing via email to hello@allsome.my within 30 days of the booking order. If compensation happened, this will be paid directly into your given bank account.
3. We do not exclude or restrict in any way our liability for death or personal injury resulting from our own negligence or the negligence of our employees or agents acting in the course of their employment or agency or for fraud or fraudulent misrepresentation.
4. We shall not be liable whether in contract, tort, under statute or otherwise (including in each case negligence) for any of the following type of losses or damages arising under or in relation to provision of the Service:
• Special, indirect or consequential loss or damage whatsoever;
• Any loss of profits, business contracts, anticipated savings, goodwill or revenue (whether direct or indirect).
5. Notwithstanding Clause 8.3 for which our liability is unlimited, our entire liability whether arising from our breach of contract, negligence, or breach of statutory duty in connection with our supply of the Service to you shall be limited to the value of the Parcel contents or RM200.00, whichever is lower.
6. If delivery of your Parcel is attempted outside of the NearPost Station's working hours and is left outside a NearPost Station or with a third party, we shall not accept liability for the Parcel contents.
7. The Company is not liable in respect of any Parcels delivered to NearPost Station.
8. We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by uncontrollable events:
   Any act or event beyond our reasonable control including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, street rallies, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks which prevents us from supplying the Service to you.
9. Variations
1. No variation, extension or cancellation of these Terms shall be binding upon the Company unless and until it is confirmed in writing under the hand of a Director of the Company and, for the avoidance of doubt, it is declared that no person other than such Director has authority to negotiate or enter into any commitment on behalf of the Company the effect of which would or might (but for this present clause) involve the Company in any legal liability whatsoever. Any future versions of these Terms appearing on the Company Website are deemed confirmed in writing under the hand of a Director of the Company.
2. We may amend or repeal these Terms at any time by giving advanced 10 days' notification notice, such notification to be posted on the Company Website and your attention drawn to it by email. Your continued use of the Service will constitute acceptance of the revised Terms.
10. Applicable Law
1. These Terms shall be construed in accordance with the laws of the Federal Constitution of Malaysia.
2. The Courts of Malaysia shall have exclusive jurisdiction in relation to any matters arising out of a contract incorporating these Terms.
11. Definitions
1. "Article" means any article which is not a Prohibited Article and "Articles" shall be construed accordingly.
2. " NearPost Station " means a NearPost location listed on the Company Website that you can book a NearPost service and delivered a parcel to.
3. "Company" or "we" or "us" or "our" or "ourselves" means between Yimport Enterprise (002297420-X), a company duly incorporated in accordance with the Companies Act 1965 and the Regulations and includes the Company's servants, agents, and any person or persons receiving, storing or carrying Parcels under the contract with the Company (including but not limited to NearPost Agents).
